I am writing to express my strong opposition to the proposed rule that restricts sex and gender markers to biological sex at birth on ATF regulatory paperwork, such as Form 4473.This rule will create immediate administrative confusion for law enforcement and federally licensed firearms dealers (FFLs).
Many states explicitly issue driver's licenses and state IDs with nonbinary markers or updated gender markers that reflect a person's lived identity. Forcing an applicant to select a marker that contradicts their valid state-issued identification will lead to unnecessary delays, background check mismatches, and bureaucratic friction.
Furthermore, forcing individuals to disclose private medical or biological history that is irrelevant to public safety or firearm eligibility is an unwarranted invasion of privacy. The ATF should prioritize streamlined, accurate record-keeping that aligns with modern state identification standards. I urge the agency to withdraw this proposal.
