Avoid Unnecessary Litigation
Ambiguous regulations rarely remain ambiguous for long—they become the subject of protests, appeals, and litigation. SBA can avoid those outcomes by clarifying the final rule before implementation. Clear definitions, examples, and explanations regarding the continuing role of personal experiences, longstanding disadvantage, and evidentiary requirements will benefit applicants, reviewers, and the Agency itself.
I doubt Mrs. Loeffler is going to stick around to just try to change this regulation. An unclear proposed reg will be changed to reduce any impact she may have as an Administrator. So her legacy at SBA among minorities, women, veterans and poor communities will be tarnished because this reg seems to further alienate small business govcons and borrowers.. It will ameliorate an important part of the voter base. I'm sure that's not what she wants to do - but her legacy already is tainted by her disregard for minorities. Even here - b/c the regs are vague - she will also be ineffective in her preference to favor white males. It would be nice if she appointed a person capable of following through on her agenda. Ryan Lambert is not that person.
