I support the Pipeline and Hazardous Materials Safety Administration’s proposed updates to the Hazardous Materials Regulations. Hazardous materials are transported through communities every day by highway, railroad, and vessel, so the rules governing these operations must be clear, practical, and focused on preventing accidents. The proposal appears to balance public safety with the need for a more efficient regulatory process. In particular, clarifying which businesses qualify as tank car facilities could reduce confusion and help ensure that the facilities responsible for inspecting and approving tank cars understand their obligations. Requiring appropriate registration, quality-assurance procedures, testing, and government oversight can help prevent leaks, equipment failures, and other incidents that could place transportation workers, first responders, nearby residents, and the environment at risk. I encourage PHMSA to adopt these changes while continuing to closely monitor compliance and enforcement. Any effort to simplify approval requirements should not weaken inspections, employee training, recordkeeping, or accountability. The final rule should also provide clear guidance and enough implementation time for affected businesses to understand and comply with the updated requirements. Overall, I believe the proposal can improve both transportation safety and regulatory clarity.
