Summary: The commenter opposes the proposed pseudonymizing protocol for medical information, arguing that it is insufficient to protect the privacy and security of federal judges and their dependents. They express concern over the lack of notice to judges and the potential for the information to be misused by the executive branch.
“The proposed pseudonymizing protocol is insufficient to protect confidential, sensitive medical information of judges and their dependents. The proposed protocol also fails to give advanced notice to judges that their information is sought to be disseminated, nor does it provide any notice - after-the-fact - that it has been disseminated. In an era of ever-growing security risks, the proposed protocols also offer no protection of the information once it has been released under the proposed protocols set forth in the June 2026 Notice. I am am also very concerned about the potential misuse of information. In the growing antagonism between the executive branch and judiciary, there is palpable concern that information may be used for ulterior, improper purposes. I strongly urge OPM to reconsider its proposal so sensitive medical information of federal judges and their dependents are protected, and that in place of the current propose, OPM propose revised protocol that is strategic and mindful of security risks and dangers.”
