Summary: The commenter suggests that the proposed rules should be expanded to include supervisors and managers, who are often responsible for fraud, waste, and abuse. They also express concern regarding the potential impact on whistleblowers and the need to address retaliation.
The rules substantially focus on non-supervisory employees instead of supervisory employees. For every instance where fraud, waste, and abuse occurs in a federal agency, there is a supervisor or manager who knew or should have known. If this rule is implemented it should equally apply to Managers and Supervisors in maintaining a high performance. Likewise, it should take into consideration the effects such rules will have on whistleblowers and address issues surrounding whistleblower retaliation concerning performance and adverse actions.
