Recommend adding an exception to RFO FAR 5.101(b) to include contract actions expressly authorized or required by a statute to be made through another Government agency. This was historically included as part of the exception prior to the RFO. There shouldn't be any reason why the Government is required to notify the public of an intention to award a contract action expressly authorized by statute (for example, the DoD issuing a direct award to a Native Hawaiian Organization through the Small Business Administration under DFARS 219.108-7(b)(i) (Class Deviation 2026-O0037) or the Uniformed Sciences University of the Health Sciences issuing a direct award to a non-profit entity under 10 U.S.C. 2113(g)).
