Summary: The commenter is seeking clarification regarding a change in the FAR regarding the requirement to post presolicitation notices to the GPE. They specifically ask why certain exemptions for acquisitions authorized by other agencies or specific sources were omitted in the proposed text.
In the pre-RFO FAR, 5.202(a)(4) stated that synopsis of proposed contract actions was not required if "[t]he proposed contract action is expressly authorized or required by a statute to be made through another Government agency, including acquisitions from the Small Business Administration (SBA) using the authority of section 8(a) of the Small Business Act (but see 5.205(f)), or from a specific source such as a workshop for the blind under the rules of the Committee for Purchase from People Who Are Blind or Severely Disabled[.]"
The proposed text of post-RFO FAR 5.101(b) does NOT exempt proposed acquisitions of the type described in pre-RFO FAR, 5.202(a)(4) from the requirement to post a presolicitation notice to the GPE.
Is there a reason for this omission, or was this omission an oversight?
