Summary: The commenter recommends adding a specific subparagraph to FAR 4.402 to include FAR 52.212-4 (Terms and Conditions—Commercial Products and Commercial Services). They argue that without this addition, the record retention requirements in FAR 52.212-4 (t)(2) would become meaningless because the current scope of FAR subpart 4.4 would not apply to them.
Currently, and proposed, the applicability of FAR subpart 4.4 (formerly FAR subpart 4.7) does not include FAR 52.212-4 Terms and Conditions—Commercial Products and Commercial Service. Paragraph (t) of FAR 52.212-4 requires the use of the subpart. Please add a subparagraph FAR 4.702(a)(3) Terms and Conditions—Commercial Products and Commercial Services (52.212-4).
