The US EPA shouldn't remove the Air Nuisance Rule because it is an essential protection for Ohio's environmental justice communities. The Ohio EPA asked for the removal based on an unconstitutional mandate from the Ohio General Assembly. The US EPA shouldn't make a final decision until litigation over the legislative mandate to remove the Air Nuisance Rule concludes.
