I oppose this proposed rule.
The collection of workforce demographic data is essential to ensuring equal employment opportunity and enforcing our nation’s civil rights laws. These reporting requirements provide one of the few objective ways to identify patterns of discrimination, measure progress over time, and detect systemic barriers that might otherwise go unnoticed.
Eliminating these reporting requirements would significantly reduce transparency and make it more difficult for enforcement agencies, policymakers, researchers, and the public to evaluate whether equal employment opportunity laws are being effectively upheld. Reliable data is critical to identifying disparities, informing evidence-based policy, and promoting fair and equitable workplaces.
Although reducing unnecessary administrative burdens is an important goal, eliminating these reporting requirements entirely would undermine accountability and weaken the ability to detect and address unlawful discrimination. The public benefits of maintaining these data collections outweigh the administrative burden associated with reporting.
For these reasons, I respectfully urge the Equal Employment Opportunity Commission to withdraw this proposed rule and retain the existing reporting and recordkeeping requirements.
