Summary: The commenter suggests several improvements to the EEOC's strategic plan, including increasing and stacking punitive damages caps to better deter discrimination. They also recommend improving inter-agency coordination, providing more frequent investigation updates, and establishing a pro-bono referral program to assist unrepresented victims.
If feasible: -Increase cap on punitive damages, particularly with systemic cases to help deter employers from engaging in discrimination in the first place. -Allow punitive damages cap to stack by discrimination category -Where oversight overlaps with other federal and state agency, initiate coordination between other agencies promptly to help distribute the load and expedite investigations. -If possible, provide more detailed updates throughout the investigation, even if it is through an automated system. If the EEOC determines discrimination has occurred on one level but is still investigating another, can this be communicated? If the EEOC is working with other agencies, can this be communicated? -Establisg a pro-bono, referral, or similar program to help those needing representation but are unable to secure it. This could also return time back to EEOC staff.
