Summary: The commenter supports the proposed rule change to define "willfully" for firearms violations. They argue that the previous zero-tolerance policy unfairly penalized gun shop owners for clerical errors and believe the new standard will protect good-faith actors.
I strongly support this proposed rule change. Under the previous Administration's direction for the ATF to adopt a zero-tolerance policy has caused harm to our local gun shops that strive to obey every component of the law. My local gun shops check and double check forms to make sure they are filled correctly and it is unfair to harshly penalize them for a simple clerical mistake that we all are capable of making. With the legal standard of willfulness existing to protect good-faith actors, I urge the ATF for finalize this rule and end the zero-tolerance policy permanently.
