Summary: The commenter, a Federal Firearms Licensee (FFL), supports the proposed rule to define "willfully" for firearms violations. They argue that the current zero-tolerance policy unfairly penalizes law-abiding dealers for honest clerical mistakes and advocate for a standard that protects good-faith actors.
I strongly support this proposed rule. ATF's zero-tolerance enforcement policy has caused serious harm to law abiding firearms dealers, their business, families, and their communities by making them out to be criminals for simple clerical mistakes, even though they step by step and lawfully conducted business. As an FFL myself, I live in constant fear that a simple and honest mistake, a misplaced digit, a missed checkbox, could cost me the license I built my business on. The legal standard of willfulness exists to protect good-faith actors. I urge ATF to finalize this rule and end the zero-tolerance policy permanently.
