Summary: The commenter, identifying as a gun owner, supports the proposed rule to remove the Youth Handgun Safety Act notice. They argue that the ATF lacks the statutory authority to require FFLs to distribute the notice and that it constitutes an unauthorized administrative burden.
I am in support of this proposed rule. While a paper notice regarding the Youth Handgun Safety Act is obviously not a bad thing, ATF has no regulatory authority to enforce this if it was not authorized by Congress, and the GCA does not require FFLs to distribute this notice for handgun sales. Private sellers do not provide a copy of the notice. In principle, ATF should not force FFLs to perform an action (at the FFLs own cost) it has no statutory authority over. Therefore, as a gun owner who values constitutional government, I support removing this unauthorized, administrative add-on. ATF should finalize RIN 1140-AA87. Thank you.
